On December 1, 2009 the Environmental Protection Agency published a final rule establishing Clean Water Act (CWA) technology-based Effluent Limitations Guidelines and New Source Performance Standards for the Construction and Development (C&D) point source category. AGA worked with a multi-industry coalition to file extensive comments regarding the impacts of the proposed rule on linear projects. Rather than exempting all linear projects from the effluent limitations, EPA decided to make revisions to the rule to address the fact that sediment basins do not work for linear projects. Natural gas utility projects that affect more than one acre of land are subject to the rule.
