AGA Comment Letter on EPA Draft Guidance on Waters of the United States (July 29, 2011)

On July 29, 2011, AGA joined in the extensive comments filed by the Water Advocacy Coalition on the Draft Guidance prepared by EPA and the U.S. Army Corps of Engineers on the scope of waters considered to be subject to federal Clean Water Act requirements as "Waters of the United States." AGA also filed a short separate comment letter highlighting our particular concerns about the unnecessary burdens the Guidance would impose on natural gas pipelines and utility lines, which are linear and have only temporary impacts. The AGA comment letter also emphasizes the need for options to presume that waters are subject to federal jurisdiction where such a presumption can lead to expedited permitting.
