On November 4, 2008 AGA filed an amicus brief supporting SDG&E in the case United States v. San Diego Gas & Electric Company. AGA noted that its members are directly affected by the lack of clarity and fair notice in the asbestos NESHAP sampling and testing rules resulting from EPA’s inconsistent interpretation of its rules as applied to asbestos coal tar pipe wrap. The anmicus bried stated that a new trial should be affirmed because the regulations that the defendants were alleged to have violated are unenforceable because they did not have adequate notice and were denied due process of law.
