AGA/EPA Boiler MACT Letters re Sierra Club Petition for Reconsideration (July 2011)
After the U.S. Environmental Protection Agency (EPA) promulgated its industrial boiler rule last March, the Sierra Club and other environmental organizations filed a petition against EPA's establishing work practice standards as Maximum Achievable Control Technology (MACT) standards for all gas fired boilers. On July 15, 2011 AGA wrote a letter to EPA urging the Agency to grant the Sierra Club petition to reconsider its establishment of work practice standards as MACT for industrial boilers. This would almost inevitably lead to a stay of litigation on this point pending completion of the reconsideration. EPA responded to AGA's letter on July 28, 2011 stating that the reconsideration issues will be announced when EPA releases the reconsideration proposal at the end of October 2011.
