Sierra Club v Bostick - AGA Moves to Intervene in Support of Streamlined Utility Wetlands Permit (July 30, 2012)
On June 29, 2012, Sierra Club filed a complaint in federal district court in Oklahoma challenging the U.S. Army Corps of Engineers wetlands permits for sections of the Keystone oil pipeline to be constructed by AGA pipeline member TransCanada in Oklahoma and Texas. Sierra Club, Inc. v. Bostick, 5:12-cv-00742 (W.D. Okla. 2012). Importantly, Sierra Club seeks not only to block this particular project but also to have the court strike down the streamlined wetlands permit-by-rule program for utility line construction projects under Nationwide Permit (NWP) 12, including natural gas pipelines and distribution mains. This is a priority issue for AGA. Our members use NWP 12 every day to facilitate their infrastructure projects.
