AGA Oct. 2017 Comments on Corps of Engineers' Regulatory Reform to Expedite Infrastructure

AGA filed comments on October 18, 2017, proposing ideas for improving the U.S. Army Corps of Engineers' (Corps) permitting programs under section 401 of the Clean Water Act (CWA) (state water quality certifications), CWA section 404 (work in wetlands and other features deemed "waters of the U.S.") and 408 of the Rivers and Harbors Act (authorizing projects that affect the Corps' public works projects such as dams, levees, and dredged channels), so that natural gas utility and transmission pipeline projects can proceed expeditiously while protecting environmental resources. AGA also suggested steps the Corps could take to ensure that streamlined nationwide permits (NWPs) 3 and 12 for utility and pipeline projects are not unduly restricted by unreasonable regional conditions imposed by Corps district offices.
