PHMSA Notice and Request for Comment: Excess Flow Valve Information Collection (May 15, 2012)
On May 15, 2012 PHMSA published a notice to the Federal Register to address NTSB's Safety Recommendation P 01 2 and the EFV requirements mandated by Congress in the Pipeline Safety, Regulatory Certainty, and Job Creation Act of 2011. NTSB's Safety Recommendation P 01 2 advised DOT to require the expanded use of EFVs in gas distribution systems, when available technology can be applied. The Pipeline Safety Act of 2011 requires that PHSMA issue a report on NTSB's recommendation and, if appropriate, require operators to install EFVs on new or entirely replaced distribution branch services, multifamily facilities, and small commercial facilities where "economically, technically, and operationally feasible."
In order to gather sufficient data on operations, costs, and benefits of EFVs to meet this mandate and to develop a cost benefit analysis for the 2011 EFV ANPRM, PHMSA is proposing to use an online census for information collection. A copy of the census has been placed in the docket for comment and PHMSA will request three years for this information collection activity.
