California Restaurant Association v. City of Berkeley, No. 21-16278
On April 17, 2023, the U.S. Court of Appeals for the Ninth Circuit issued an opinion which held that the Energy Policy and Conservation Act preempts the City of Berkeley’s ordinance that prohibits the installation of natural gas piping within newly constructed buildings.
